Dear Sirs,
at this moment I do not want to delete my Canon Image Gateway account (yet) but would like to raise issues regarding the "Terms and Conditions" stipulated by Canon Europe on this website:
http://my.canon-europe.com/info/tandc_popup.html
As a Canon customer and registered user of the Canon Image Gateway I would like to express my concern with the terms and conditions of the "my Canon" Services, especially with regards to the following passage in section 3:
" ... By sending Canon any information or material, you grant to Canon an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute that material or information, and you also agree that Canon is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. ... "
I would like to raise the following questions:
* why does Canon include this statement in this wording as part of the websites T&C
* why would Canon try to get an unrestrectried, irrevocable (!!!) license to any contents sent to your website - namely and presumably photographic digital images to which the users hold any and all rights?
* has Canon been using any of my posted pictures under this "license"? If so, which ones and for what purposes? To help answer this question I will supply requisite user id of my account once I receive a qualified repsonse
I view these terms and conditions to be grossly unfair - even when considering that use of the website is provided free of charge and on a voluntary basis.
Especially the above sentences in their all-inclusive, sweeping wording and meaning and the failure to provide users with a possibility to revoke any possible license granted, is in my view contrary to any consumer rights, contrary to fair and proper conduct of any company or corporation and may even be illegal in my jurisdiction.
I expect Canon Europe to remove the above passage from its terms and conditions as soon as possible.
Looking forward to receiving answers to my questions soon,
Yours,
